Article 2 – Purpose

These General Terms and Conditions of Sale govern the sale of clothing, footwear, and accessories offered on the www.hayamodest.com website.

Article 3 – Products

The products offered for sale are described and presented as accurately as possible.

However, the photographs and visuals on the website are not contractual and cannot engage HAYA MODEST's responsibility.

Article 4 – Prices

Prices are indicated in euros, inclusive of all taxes.

HAYA MODEST reserves the right to change its prices at any time. Products will be invoiced based on the rate in effect at the time the order is confirmed.

Products remain the property of HAYA MODEST until full payment of the price.

Upon delivery or collection of the order, the risks of loss or damage are transferred to the customer.

Article 5 – Orders

Any order placed on the website implies full and complete acceptance of these General Terms and Conditions of Sale.

HAYA MODEST reserves the right to refuse or cancel any order in the event of an existing dispute with the customer, suspicion of fraud, or payment incident.

The customer will receive a confirmation email summarizing their order.

Article 6 – Payment

Payment for orders is made using the payment methods offered on the website, including:

* PayPal

The order is considered validated after payment acceptance.

HAYA MODEST reserves the right to suspend any order in the event of payment authorization refusal.

Article 7 – Product Availability

Products are offered within the limits of available stock.

In the event of an item being unavailable after order validation, the customer will be informed as soon as possible.

HAYA MODEST may offer an exchange, a credit note, or proceed with a refund for the unavailable item.

Article 8 – Delivery and In-Store Collection

Orders are prepared within 24 to 72 business hours.

Products are delivered to the address indicated by the customer when placing the order.

Delivery times are indicative and depend on the selected carrier.

HAYA MODEST cannot be held responsible for a delivery delay attributable to the carrier.

In the event of an error in the delivery address provided by the customer, HAYA MODEST cannot be held responsible for the impossibility of delivering the package.

For deliveries to a relay point, any package not collected within the time limit set by the carrier will be returned to HAYA MODEST. Reshipment costs will remain the responsibility of the customer.

Free in-store collection

The customer can choose the "In-store collection" option when placing their order if it is available.

Collection is free of charge.

An email notification will be sent when the order is ready for collection.

An ID and order confirmation may be requested upon collection.

Orders are kept for 30 days from their availability. After this period, HAYA MODEST reserves the right to cancel the order after attempting to contact the customer.

Article 9 – Right of Withdrawal and Returns

In accordance with the provisions of the Consumer Code, the customer has a period of 14 days from the receipt of their order to exercise their legal right of withdrawal.

To be accepted, the return must concern an item that is:

* unworn,
* unwashed,
* undamaged,
* in its original packaging if applicable,
* with its original label intact.

Return shipping costs are the responsibility of the customer.

After receipt and verification of the returned item, a refund will be issued in accordance with current legislation.

Outside of the legal right of withdrawal, HAYA MODEST reserves the right to offer an exchange or credit note depending on the situation.

Article 10 – Legal Guarantees

Products benefit from the legal guarantee of conformity as well as the guarantee against hidden defects provided by French legislation.

Article 11 – Liability

HAYA MODEST cannot be held responsible for:

* temporary interruptions of the website;
* delays or malfunctions attributable to carriers;
* inappropriate use of purchased products;
* any indirect damage resulting from the purchase or use of the products.

The information collected during orders is necessary for the processing and tracking of purchases.

In accordance with the General Data Protection Regulation (GDPR), each customer has the right to access, rectify, delete, restrict, and object to the processing of their personal data.

These General Terms and Conditions of Sale are subject to French law.

In the event of a dispute, an amicable solution will be sought first.

Failing amicable agreement, French courts will have sole jurisdiction.
